Mandatory Retirement offends Charter: Federal Court – CARP calls for Parliamentary Action

The Federal Court upheld the Tribunal’s August 2009 Rights Decision, but it did not strike down that exemption, which would have eliminated mandatory retirement for those thousands of other employees in the federal jurisdiction, including employees at Air Canada.

Air Canada and the pilots’ union have thirty days from the February 3rd decision to file an appeal to the Federal Court of Appeal. Given the public interest and legal significance of the decision, an appeal is likely and ultimately, the case is likely to wind up before the Supreme Court of Canada.
